Terms of Service
Effective date: 6 June 2026
These Terms of Service ("Terms") are a binding agreement between you ("you", "your", or "User") and Kateryna Musaieva, a private entrepreneur (FOP) registered in Ukraine ("Tungsten People", "we", "us", or "our"). They govern your access to and use of the Tungsten People website at tungstenpeople.com, the web application at app.tungstenpeople.com, and all related content, features, and services (together, the "Service").
Please read these Terms carefully. By creating an account, subscribing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree, do not use the Service.
These Terms contain important provisions that limit our liability, disclaim warranties, and govern how disputes are resolved. They do not affect any mandatory rights you may have under the consumer-protection laws of your country of residence.
1. What Tungsten People Is (and Is Not)
Tungsten People is an online subscription service that helps you prepare for the FRCR Part 2B examination. The Service may include an adaptive study plan, spaced-repetition flashcards (text only), readiness analytics, and, where made available, additional study tools such as an AI-assisted mock viva.
- The Service is an online study aid provided for educational purposes only. All content is provided for the purpose of helping you study and self-assess for an examination.
- The Service is not professional advice. It is intended only to support your own exam preparation and should not be relied on for any other purpose.
- The Service is a supplement, not a substitute, for your own preparation, official curricula, or any examining body's own materials.
- We do not guarantee any outcome. We do not guarantee that you will pass the FRCR Part 2B examination or any other examination, or that the Service will improve your score, readiness, or results.
2. No Affiliation With the Royal College of Radiologists
Tungsten People is an independent product. We are not affiliated with, endorsed by, sponsored by, or connected to the Royal College of Radiologists (RCR) or any other examining or licensing body. "FRCR", "Royal College of Radiologists", and "RCR" are names and/or trademarks of their respective owners and are used only to describe the examination for which the Service helps you prepare. We do not provide official examination questions, official answers, or any official examination materials.
3. Eligibility and Professional Use
- You must be at least 18 years old and able to form a legally binding contract to use the Service.
- The Service is intended for adults studying for the FRCR Part 2B examination. It is offered for educational use.
- You represent that the information you provide to us is accurate and that you will keep it up to date.
- You may not use the Service if you are barred from doing so under any applicable law or if your account has previously been suspended or terminated by us.
4. Accounts and Security
To use most features you must create an account. Account creation and authentication are handled through a third-party provider.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- Each account is for a single individual. You may not share, sell, transfer, or allow others to use your account or login credentials.
- You must notify us promptly at hello@tungstenpeople.com if you suspect any unauthorized use of your account or any security breach.
- We are not liable for any loss or damage arising from your failure to keep your credentials secure or from unauthorized use of your account that results from your acts or omissions.
5. Subscriptions, Billing, and Payment
5.1 Payments Are Processed by Paddle as Merchant of Record
When you purchase a subscription, your order is placed with and fulfilled through Paddle.com Market Limited and its affiliates ("Paddle"), which act as the Merchant of Record and authorized reseller of our subscriptions. This means:
- Paddle, not Tungsten People, is the seller of record for your purchase. Paddle's name (or the name of a Paddle entity) may appear on your card or bank statement.
- Paddle handles checkout, payment processing, billing, currency conversion, invoicing, and the calculation and collection of applicable taxes (such as VAT, GST, and sales tax).
- Your purchase is subject to Paddle's own Buyer Terms and Paddle's Refund Policy in addition to these Terms. Payment, billing, tax, and refund matters are governed by Paddle's terms; your use of the Service is governed by these Terms.
- For questions about a charge, a receipt, a payment method, or a refund, you should contact Paddle, or contact us at hello@tungstenpeople.com and we will direct the request to Paddle where appropriate.
5.2 Auto-Renewal
Subscriptions are sold on a recurring monthly basis per exam course. Unless you cancel, your subscription automatically renews at the end of each billing period, and the then-current fee is charged through Paddle for the next period. By subscribing, you authorize these recurring charges until you cancel.
5.3 Cancellation
- You may cancel at any time through your account settings or your Paddle subscription-management link.
- Cancellation stops future renewals. It takes effect at the end of the current paid billing period, and you keep access until then.
- Cancellation by itself does not entitle you to a refund of amounts already paid. Any refund is governed by our Refund Policy and by Paddle's Refund Policy.
5.4 Price Changes
We may change subscription prices. We will give you reasonable advance notice of any price change before it applies to you, and a price change will only take effect at the start of a new billing period. If you do not agree to a new price, you may cancel before it takes effect.
5.5 Free Trials and Promotions
If we offer a free trial or promotional rate, the specific terms will be presented at sign-up. Unless stated otherwise, a paid subscription begins automatically at the end of any free trial unless you cancel before the trial ends.
6. License to Use the Service
Subject to your compliance with these Terms and payment of applicable fees, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service and its content for your own individual exam preparation. This license exists only for as long as your subscription or account is active and may be revoked by us as set out in these Terms.
7. Intellectual Property and Prohibited Uses of Content
All content and materials in the Service, including flashcards, study plans, analytics, explanations, text, questions, designs, layouts, graphics, logos, software, and the selection and arrangement of all of these, are owned by Tungsten People or our licensors and are protected by copyright, trademark, database, and other laws. Except for the limited license in Section 6, no rights are transferred to you.
You must not, and must not permit or assist anyone else to:
- copy, reproduce, download in bulk, archive, screenshot systematically, record, or otherwise extract content except for your own incidental personal study;
- scrape, crawl, harvest, or use any automated means, bot, or script to access or collect content or data from the Service;
- share, sell, rent, sublicense, redistribute, publish, or make the content or your account available to any other person;
- share or pool a single account among multiple users;
- reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying structure of the Service, except to the extent this restriction is prohibited by applicable law;
- remove, obscure, or alter any copyright, trademark, or other proprietary notices;
- use the content or any part of the Service to train, develop, or improve any machine-learning model or artificial-intelligence system, or to build, support, or operate any product or service that competes with the Service.
We reserve all rights not expressly granted to you. Any feedback or suggestions you give us about the Service may be used by us freely and without obligation to you.
8. Acceptable Use and Prohibited Conduct
You agree not to:
- use the Service for any unlawful purpose or in breach of any applicable law or regulation;
- upload or transmit any material that is unlawful, infringing, harmful, or that contains malware;
- attempt to gain unauthorized access to the Service, other users' accounts, or our systems or networks;
- interfere with, disrupt, overload, or degrade the Service or the servers or networks that support it;
- circumvent, disable, or interfere with any security, access-control, usage-limit, or authentication feature;
- misrepresent your identity, impersonate any person, or provide false registration information;
- use the Service in any way that could harm Tungsten People, other users, or any third party.
9. Third-Party Services
The Service relies on and may link to third-party services, including our payment provider Paddle (Merchant of Record). Your use of any third-party service is governed by its own terms and privacy policies. We do not control and are not responsible for the availability, content, security, or practices of any third-party service, and any community discussions are not professional advice. Your dealings with any third party are solely between you and that third party.
10. Educational Disclaimer and No Warranties
The educational disclaimers in Section 1 are repeated and reinforced here. In addition:
The Service and all content are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty arising from course of dealing or usage of trade.
- We do not warrant that the content is accurate, current, complete, error-free, or aligned with the latest examination syllabus.
- We do not warrant that the Service will be uninterrupted, secure, timely, or free of errors, bugs, or harmful components.
- You are responsible for verifying any important information against authoritative sources and your own preparation.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you to the extent prohibited by mandatory law.
11. Changes to the Service
We are continuously developing the Service. We may add, change, suspend, limit, or discontinue any feature, content, or part of the Service at any time, including features that are described as planned or on our roadmap (such as the AI mock viva) and which may never be released. We will try to give reasonable notice of significant changes that materially reduce the core functionality you are paying for.
12. Limitation of Liability
To the fullest extent permitted by applicable law:
- Tungsten People, its owners, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, study time, or examination opportunity, or for any examination result, however caused and under any theory of liability, even if we have been advised of the possibility of such damages.
- Our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms will not exceed the total amount you actually paid for the Service in the twelve (12) months immediately before the event giving rise to the claim (or, where local mandatory law sets a different minimum, the higher of that amount and any minimum required by law).
Nothing in these Terms excludes or limits our liability for anything that cannot lawfully be excluded or limited, including death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that mandatory law does not permit to be limited. If you are a consumer, these limitations apply only to the extent permitted by the consumer-protection laws of your country of residence, and they do not affect your mandatory statutory rights.
13. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Tungsten People and its owners, directors, employees, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Service; (b) your breach of these Terms; (c) your violation of any law or of any third party's rights; or (d) any content or information you submit. This Section does not apply to the extent a loss is caused by our own breach or where mandatory consumer law does not permit such indemnification.
14. Suspension and Termination
- You may stop using the Service at any time and may cancel your subscription as described in Section 5.
- We may suspend or terminate your access immediately, without refund, if you breach these Terms, misuse the Service, infringe our intellectual property, or if we are required to do so by law, or to protect the Service or other users.
- On termination, your license and your right to access the Service end immediately. Sections that by their nature should survive termination (including Sections 7, 10, 12, 13, 15, 16, and 17) will continue to apply.
- Termination of your account does not by itself entitle you to a refund; refunds are handled under our Refund Policy and Paddle's Refund Policy.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and take reasonable steps to notify you, for example by email or by a notice within the Service. Changes take effect when posted unless stated otherwise. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree, you must stop using the Service and may cancel your subscription.
16. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of Ukraine, without regard to its conflict-of-laws rules. The courts of Ukraine will have jurisdiction over any dispute, except where mandatory law gives you the right to bring proceedings in your own country of residence.
This Section is without prejudice to any mandatory consumer-protection rights you have under the laws of your country of residence. If you are a consumer, nothing in this Section deprives you of the protection of, or your right to rely on, the mandatory consumer laws and the courts of the country where you live.
Before starting any formal proceedings, we encourage you to contact us at hello@tungstenpeople.com so we can try to resolve the matter informally.
17. General
- Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.
- Entire agreement: These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us about the Service and replace any prior agreements on that subject. Payment, billing, and refund matters are also subject to Paddle's Buyer Terms.
- No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- No agency: Nothing in these Terms creates any partnership, agency, or employment relationship between you and us.
